REGULATIONS of the VIA REGIA 2024 Berlin – Warsaw

The Via Regia is a cycling ultramarathon, the aim of which is to promote an active and sportive lifestyle, popularisation of adventure cycling, discovery of natural and historical values of the areas through which the route runs, promotion of the towns and villages lying along the ultramarathon route, bringing together Polish and German cycling communities, promotion of European values.

I. PRELIMINARY PROVISIONS

  1. The Via Regia Ultramarathon is organised in the form of a cycling ultramarathon with the principle of self-sufficiency and the possibility of non-stop cycling.
  2. The rally takes place on the route Berlin – Warsaw (about 650 km) and is conducted on asphalt, gravel, dirt and forest roads.
  3. The ultramarathon routes are led along municipal roads, county roads, national roads, international cycling routes and cycle tracks.
  4. Participation in the event is entirely voluntary and possible only aWer prior familiarisation with and acceptance of these Rules.
  5. Compliance with these Rules by participants in the ultramarathon is mandatory.
  6. The Via Regia Ultramarathon is not a mass sports event within the meaning of the Act of 20 March 2009 on mass event safety and is not an event causing traffic obstructions or requiring special road use, in particular within the meaning of: i. Art. 65 of the Traffic Law Act of 20 June 1997 (hereinaWer: Traffic Law) and the Act of 21 March 1985 on Public Roads.

II. ORGANISERS

The organisers of the Via Regia cycling ultramarathon are: Mazovia Gravel Association

(KRS 0000878656, NIP 9512513227) and Gravel Polska sp.j. (KRS 0000992132, NIP

951254940)

III. DATE AND PLACE OF THE EVENT

  1. The Via Regia cycling ultramarathon will take place on 2-5 May 2024.
  2. The ultramarathon will start on May 2, 2024 at Kienberg Hill in Berlin
  3. Finish and opening times of the race office will be given in the start announcement and on the viaregia.cc website.
  4. Participants have until 5 May at 23:59 to complete the rally
  5. The ultramarathon route runs through Poland and Germany. The detailed route will be made available at www.viaregia.cc.
  6. The organiser reserves the right to change sections of the race route if necessary. 7. The final version of the route will be presented no later than 28.04.2024.

IV. TERMS AND CONDITIONS OF PARTICIPATION

  1. 1The Via Regia cycling ultramarathon is intended for amateurs of cycling with a very good level of fitness. The organiser recommends adequate preparation and previous training in long-distance cycling which.   2. A minimum age of 18 years is required to take part.
  3. It is possible to take part in the ultramarathon on any type of muscle-powered bicycle or unicycle. It is also possible to start on bicycles and electric-powered vehicles, however, in this case the participant will not be classified.
  4. Advance booking of accommodation before the start of the race is prohibited. Reservations may be made and accommodation points may be planned as soon as the participant crosses the start line. Any form of pre-planned outside assistance by persons not participating in the race is prohibited. Driving under the influence of alcohol or other drugs. It is forbidden to use own accommodation or food facilities.
  5. Group riding with other ultramarathon participants is permihed.
  6. The participant is obliged to have an efficient bicycle and to take responsibility for its technical condition.
  7. It is obligatory to have the following equipment: rigid helmet, night lights and in case of poor visibility (front – white, rear – red), daytime running lights (white at the front, red at the back), identity card with a photo of a cyclist and a mobile phone with number given during registration.
  8. Participation in the Via Regia cycling ultramarathon is conditional upon reading and accepting these Rules and Regulations, submiing a declaration of participation in the marathon to participate in the marathon at your own risk, consent to the processing of your personal data and use of your image in the marathon materials.
  9. The participant agrees to the processing of his/her personal data (in accordance with the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000) and in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data data and repealing Directive 95/46/EC(RODO).

V. REGISTRATION RULES

  1. Registration will be possible through an application form. A link to the entry form will be posted on www.viaregia.cc and on the Via Regia FB fan-page.
  2. The limit of seats in Via Regia is a total of 150 seats. The organiser reserves the right to change the place limit.
  3. Participation in the race is determined by the order of registration. The start list will be updated once every 3 days.

VI. PARTICIPATION FEE

  1. The participation fee for the Via Regia ultramarathon is 499 PLN for the distance Berlin – Warsaw.
  2. The participation fee shall be paid by bank transfer to account: 44 1140 2004 0000 3402 8284 7980 – Gravel Polska Sp.j, in the title stating: “Via Regia Ultramarathon – name and surname”.The participant has 5 working days to pay the entry fee. AWer this deadline the place returns to the general pool.
  3. The entry fee is refundable according to the schedule in Chapter VII. VII.

CANCELLATION OF PARTICIPATION

  1. A participant has the right to resign from participation in the ultramarathon without giving any reason.
  2. Information about resignation from participation in the marathon should be sent by e-mail to info@viaregia.cc or info@mazowieckigravel.pl.
  3. the participation fee will be refunded according to the following schedule:
    1. resignation by 31.01.2024 – reimbursement of 100% of the participation fee
    2. resignation until 31.03.2024 – reimbursement of 50% of the participation fee
    3. resignation after 31.03.2024 – entry fee not reimbursed
  4. The amount will be refunded to the account from which the payment was made.
  5. Refunds will be made within 5 working days from the acceptance of the application.

VIII. TRANSFERRING A PLACE ON THE ENTRY LIST TO ANOTHER COMPETITOR

  1. The organiser allows the transfer of the entry to another person.
  2. The person who resigns from the start should indicate the person to whom he/she is transferring by e-mail to info@viaregia.cc or info@mazowieckigravel.pl.
  3. Transferring a place on the entry list is subject to an administrative fee of PLN 100. In justified cases the administrative fee shall be reduced.
  4. The entry fee is transferred automatically from the designated competitor.
  5. The person to whom the transfer is made is obliged to pay an administration fee by bank transfer to Gravel Polska Sp. j. with the note “Via Regia, name and surname – number transfer” until 23.04.2024
  6. Transfer of a place on the start list is possible until 23.04.2024. AWer this date transfer is not possible.

IX. ROUTE

  1. The start will take place in groups of up to 15 people at 5-minute intervals in accordance with the division into start groups.
  2. The starting list with the division into starting groups will be published on 28.04.2023 at the latest.
  3. It is up to the riders to decide on their own strategy. Non-stop riding is possible, but for safety reasons the organiser recommends resting at night and riding in daylight. 4.
  4. The competitor must be present at the starting line 20 minutes before the appointed starting time in order to sign the necessary documents, fit the GPS device and check the compulsory equipment.
  5. If the competitor does not have the compulsory equipment, he/she is obliged to provide it. The starting time for such a person is calculated according to the allocation to the given starting group. 6.
  6. The total time to complete the distance is calculated from the starting time according to the starting group allocation.
  7. The current version of the route will be displayed electronically on the competitor’s individual account, the BBtracker app and on the BBTracker website.
  8. The organizer is not responsible for errors in map reading or errors in the GPS track used by the starters.
  9. It is possible to leave the route for the purpose of accommodation, shopping, bike service, medical assistance or other activities necessary for the completion of the race. In case of leaving the ultramarathon route, the competitor is obliged to return to the route in the place where he/she leW it.
  10. The competitor will be equipped with a GPS transmiher provided by the organiser which will monitor his/her position on the route throughout the race.
  11. Tracking of competitors’ positions will be possible via a website and will be publicly accessible. The website address will be given as an update of these regulations.
  12. Each competitor will be able to download the route in .gpx file format.
  13. A route app for Android smartphones will be made available to competitors.

X. PARTICIPANT’S OBLIGATIONS

  1. The participant undertakes to observe the principles of fair play and the spirit of sports competition.
  2. The participant is obliged to follow the general rules of using public roads in accordance with the Road Traffic Act. 3.
  3. Participants will complete the Via Regia route on their own. 4. Participants may assist each other during the race.
  4. In the event of a breakdown, accident or other fortuitous event, competitors are obliged to assist other competitors in such an event.
  5. It is strictly forbidden to use any means of transport other than a bicycle while completing the race route. It is strictly forbidden to use organised assistance of third parties on the route.
  6. A participant who decides to withdraw from the race shall be obliged to inform the Main Judge by phone or text message.
  7. The participant is required to return the GPS device to the technical staff at the finish line of the race. In justified cases, it is possible to return the GPS device to the the address below after the decision to withdraw from the competition and leave the route before the finish line.
  8. Address for returning the tracker: BB Tracker, Świękitki 1A, 11-135 Lubomino, Warmińsko- Mazurskie Voivodeship.
  9. In the event of damage to or loss of the GPS tracker the participant will be charged a fee of PLN 500 by the organiser.

XI. BENEFITS

  1. The organisers provide the following as part of the participation fee
    – administravve services including access to competitor panel in the BBTracker system
    – access to the BBTracker application for your smartphone
    – rental of a GPS device
    – online transmission
    – access to the route in the form of .gpx file
    – t-shirt or other gadget on the occasion of the event
    – warm meal at the finish of the race
    – finisher’s drink
    – surprise gadget
    – a commemorative medal for those who have completed the race route within the time limit – awards for the best

XII. SAFETY

  1. The organisers shall make every effort to ensure the safety of participants during the race. 2. Participant takes part in the race at his/her own risk. 3.
  2. The organisers shall not be liable for any accident occurring during the commencement and return from the race as well as for any damage caused to other participants of the ultramarathon and third parties.
  3. The organisers shall not be liable for any accidents and collisions on the ultramarathon route. The organisers shall not be liable for accidents and collisions on the ultramarathon route.
  4. Organisers shall not be liable for accidents occurring on the route of the Via Regia cycling ultramarathon route and for any loss of life or health.
  5. The organisers recommend that participants take out civil liability and accident insurance for the duration of the race. Participants should take out such insurance on their own.
  6. The Chief Judge reserves the right to refuse the right to start to a participant who is under the influence of alcohol or intoxicants or who does not have any of the compulsory equipment.
  7. The organiser will state in the race notice the emergency telephone number to be used in the event of an emergency. The number will be reachable 24 hours a day by both competitors and persons concerned.

XIII. ANTI-DOPING CONTROL/TESTING FOR PSYCHOACTIVE SUBSTANCES

  1. Each participant declares that on the day of the race he/she is not under the influence of any substances prohibited by POLADA and WADA and will voluntarily submit to any anti-doping control and/or psychoactive substances test.
  2. The organisers reserve the right to carry out anty-doping control and/or psychoactive substance tests during and immediately after the race.
  3. In the event of a call for doping control by the organiser, submission to doping control and/or testing for psychoactive substances in the body is mandatory.

XIV. FINAL CLASSIFICATION

  1. The total time is counted from the participant’s starting time until the GPS device is returned at the finish of the race.
  2. A competitor’s total time may be subject to change if penalties are added by the Main Judge.

XV. CONSENT TO USE OF IMAGE

  1. The organizer of the marathon, patrons, partners and sponsors are entitled to use the image, statements and personal data of individual participants taking part in the marathon, while the image and data will be used in materials promoting the marathon and the events accompanying the marathon (press, radio, television, Internet, graphic materials). Apart from the prizes, the participants are not entitled to any further gratification, in particular remuneration for the use of their image, speech and personal data.
  2. The participants of the marathon agree to transfer copyright to their image and statements for the press, radio and television recorded by means of press, photographic and film documentation covering all fields of exploitation listed in Article 50 of the Act of 4 February 1994 on copyright and related rights (consolidated text: Journal of Laws of 2000, No. 80 item 904, as amended) to the organiser.
  3. Competitors agree to the use and publication by Gravel Poland s.j., the Mazovia Gravel Association and partners of the Association of photos and videos sent to social media films sent to the social media of the Association (FB, Instagram) as part of the race reports and competitons.

XVI. FINAL PROVISIONS

  1. The Via Regia Ultramarathon will take place regardless of the weather.
  2. The organiser reserves the right to cancel the ultramarathon in the event of force majeure or other circumstances beyond its control. In such an event, the organiser undertakes to refund all or part of the entry fee (depending on the organisational costs incurred up to the time of cancellavon of the marathon).
  3. In the event that the ultramarathon is cancelled through the fault of the Organiser, the Organiser undertakes to refund all or part of the entry fee (depending on the organisational costs incurred up to the moment of cancelling the marathon).
  4. In the event of cancellation of an ultramarathon, the Organiser may offer participation in the ultramarathon at another date.
  5. It is compulsory to comply with the regulations contained in the Rules and Regulations.
  6. The competitor is required to sign an acceptance of the terms and conditions of the regulations before the start.
  7. The organiser reserves the right to change and interpret these regulations.
